Welcome to iFieldnotes®! This Open Beta Testing Agreement ('Agreement') governs your participation in the Open Beta Testing program for iFieldnotes, a mobile application developed by iFieldnotes Limited ('Rightee'). By accessing or using the iFieldnotes Mobile App, you agree to the terms outlined in this document.

1. License. iFieldnotes Limited ('Rightee') grants you a limited, non-exclusive, non-transferable license to use the iFieldnotes Mobile App ('the App') for evaluation purposes during the Open Beta Testing Period. The Open Beta Testing Period's start and end dates are specified in the App's Settings/Account page. This period may be terminated earlier by Rightee at its discretion. The license expires at the end of the Open Beta Testing Period or upon Rightee's termination, whichever occurs first. Rightee reserves all rights not expressly granted in this license.

​2. Use and Responsibility. You acknowledge that you are responsible for any use of, and access to, the App originating from your account. The App, including all feature names, has undergone extensive testing during the Closed Beta stage and meets our standards. However, as it remains in an early development phase, it may not function as expected for all users.

3. Data Privacy: During your use of the App, Rightee may collect certain data to improve the App and analyse its performance. This may include usage statistics, crash reports, and other technical information. We will handle all data in accordance with our Privacy Policy. Personal information will be anonymised and aggregated wherever possible.

4. User Responsibilities: As a Open Beta tester, you agree to:

• Use the App regularly and as intended

• Report any bugs, errors, or issues promptly

• Provide honest and constructive feedback when requested

• Not share access to the App with any third parties

• Comply with all applicable laws and regulations while using the App​

5. Intellectual Property: The App and its content, including text, graphics, logos, and software, are the property of Rightee and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the App without express permission.

6. Prohibition of Reverse Engineering, Decompilation, and Disassembly. You acknowledge that you are prohibited to reverse engineer, decompile, or disassemble the App.

7. Feedback. Any feedback, suggestions, or ideas you provide may be used by Rightee to improve the App. By submitting feedback, you grant Rightee a perpetual, worldwide, royalty-free license to use, modify, and incorporate your feedback without restriction. While we value your input, we cannot guarantee that your specific suggestions will be implemented or that you will receive individual credit for ideas that are incorporated.

8. Support and Updates. During the Open Beta Testing Period, Rightee will provide support through your email address or our LinkedIn community. We will respond as soon as possible, but we do not guarantee resolution of all issues. Rightee may release updates to the App during the testing period, which you agree to install promptly to continue participation.

9. Limitation of liability. Notwithstanding anything to the contrary in the standard terms or any other agreement between you and Rightee, in no event will Rightee or its licensors be liable to you or any other party for damages of any kind arising from this Agreement or the use of the App, whether resulting from tort (including negligence), breach of contract or other form of action, including but not limited to loss or inaccuracy of data, interruption of use, loss of profits or revenue, or direct, indirect, special, incidental or consequential damages of any kind, even if Rightee has been advised of the possibility of such damages.

10. Warranty. You acknowledge and agree that the App is in an early development phase, and Rightee provides no warranty, express or implied, regarding the App’s performance, functionality, or features. All warranties, including but not limited to fitness for a particular purpose, merchantability, non-infringement, or any other express or implied warranty, are expressly disclaimed by Rightee. The App is provided “as is,” and you are advised against relying on any specific functionality or performance of the App for critical purposes. You agree to use the App cautiously and to take all necessary precautions to safeguard data, hardware, and software within your operating environment. Notwithstanding any other provision in the standard terms, you further agree that Rightee shall not be liable for any damages, including but not limited to direct, indirect, incidental, special, or consequential damages, or damages for lost profits, revenue, data, or usage, whether arising in contract or tort, even if Rightee has been informed of the possibility of such damages.

 

11. Term and Termination. Rightee shall have the right, at its sole discretion, to terminate this Agreement immediately with or without cause upon written notice to you. In addition, this Agreement shall terminate automatically upon any termination of the App and/or termination of the Rightee Terms of Service between you and Rightee. Sections 5 - 7 and 9 - 10 shall survive any termination or expiration of this Agreement.

 

12. Commercial Availability. Nothing in this Agreement shall be deemed to require Rightee to make the App commercially available on any particular date nor does Rightee make any such representation or warranty, express or implied, regarding any such commercially available version. Nothing in this Agreement shall be deemed to convey to you the rights to use a commercially released version of the App or any components thereof, if and when such are available. Use of such commercial product shall be subject to the Rightee Terms of Service or such other terms and conditions as Rightee requires in connection with such service.
